This report presents the findings of a three-month study, commissioned by Jersey Finance and executed by WealthBriefing, exploring the relationship between high-net-worth (HNW) individuals and philanthropy through detailed discussions with wealth professionals from firms including Barclays Private Bank, JTC Private Office, Ogier, Suntera Global and VG, based across Europe and South Africa. It notes that philanthropy is on the rise globally: ultra-high-net-worth individuals (UHNWIs, defined as those with a net worth of US$30 million or more) gave a total of US$190 billion to philanthropic causes in 2022, almost 25% more than in 2018, accounting for almost 38% of all individual giving, with the ultra-wealthy in North America contributing around half of global UHNW donations, Europeans one-third, and Asians 13%.
The study identifies five trends expected to continue shaping HNW philanthropy: a growing focus on tackling the root causes of social problems rather than just their symptoms; rising climate and ESG awareness, particularly among the next generation of HNWIs under 40, who are influencing their elders toward more ethically-aligned giving and investment; a shrinking age at which wealth-holders begin philanthropic giving, from their 70s in earlier generations to their 50s or 60s today; a growing role for women, who statistics in the study suggest represent the majority of charitable donors; and an increasing crossover between impact investing and traditional philanthropy. Respondents were notably divided on whether estate-planning structures such as charitable foundations and trusts provide good frameworks for ordered charitable giving, with the answer, the report notes, "not an unequivocal yes."
The report examines Jersey's legal and structuring framework for philanthropy, including the Trusts (Jersey) Law 1984, the Foundations (Jersey) Law 2009 — under which more than 400 Jersey foundations have been formed since their creation — and the Charities (Jersey) Law 2014. It discusses the evolving role of protectors in charitable trusts, including Jersey's provision allowing a Jersey foundation to be incorporated specifically to act as a corporate protector or enforcer of a trust — an option, the report notes, that many other international financial centres do not yet offer — as well as how Jersey's tax-efficient, tax-neutral structures balance privacy for foundations against the pressures of public visibility and unsolicited requests for funding.
